自2014年底以来,四川省绵阳市工商局针对H公司一次变更登记连续应对10次行政诉讼,该案涉及国有资产改制、股权转让和公司管理结构疑难问题,关系到几百名下岗职工切身利益。该案的成因分析和处理中的得失,对工商部门如何进一步明确公司登记审查标准,妥善处理行政和民事关系,避免国家赔偿,切实维护群众利益有重要意义。
Since the end of 2014, the Industrial and Commercial Administration of Mianyang Municipality in Sichuan Province has continuously dealt with 10 administrative proceedings against a change of registration of Company H, which involved the problems of the restructuring of state-owned assets, the transfer of equity and the difficult management structure of the company, and the immediate interests of hundreds of laid-off workers. The cause of the case analysis and handling gains and losses on the business sector how to further clarify the criteria for company registration and examination, properly handle the administrative and civil relations, to avoid state compensation, and effectively safeguarding the interests of the masses is of great significance.
