美国为避免远程存储数字作品行为侵犯著作权,对其合法性进行了定性。以Cartoon Network LP v.CSCHoldings案为例,认为目前美国判断远程存储数字作品行为是否构成著作权侵权主要看其能否适用著作权法“复制”或“公开表演权”之定义。这有其合理性,但仍存在定义界定不清、侵权类别区分不明和未圆满实现知识产权权利保护平衡三方面的缺陷。
The United States has violated copyright in order to avoid remote storage of digital works, and its legitimacy has been characterized. Taking Cartoon Network LP v. CS Holdings for example, it is considered that whether the United States judges whether the acts of remote storage of digital works constitute copyright infringement at present mainly depends on whether it is applicable to the definition of copyright law “copy” or “public performance right”. This is reasonable. However, there are still some shortcomings such as the unclear definitions, the unclear distinction between infringement categories, and the unbalanced protection of intellectual property rights.
