当代主要违宪审查模式的分析及对我国的借鉴意义

自1982年我国现行宪法实施以来,已经历经四次修改,而与之相配套的法律法规也愈加完善,我国的法律体系在不断发展健全中。然而随着“依法治国”口号的提出,建立社会主义的宪政国家越来越多的被人们所关注。一国宪法的颁布并不能证明宪政的实现,更重要的是一国建立起保障该宪法有效运行的相关体制。故此,本文拟从我国违宪审查制度的建设这一角度对有关问题进行一些探讨。

Since the implementation of the current constitution of our country in 1982, it has undergone four revisions, and the laws and regulations that accompany it have also become more perfect. The legal system of our country is constantly developing and perfecting. However, with the slogan of “governing the country according to law”, more and more people are concerned about the establishment of a socialist constitutional state. The promulgation of a country’s constitution does not prove the realization of constitutional government. More importantly, a country has established a system that guarantees the effective operation of the constitution. Therefore, this article intends to discuss some related issues from the perspective of China’s constitutional review system.
