The Mexican Foreign Investment Law has been valid for 15 years. It is generally accepted that the formulation and implementation of these laws have seriously hampered the introduction of the required capital from developed countries in Mexico in recent years and have, to a large extent, caused Mexico’s serious external debt problem. The Mexican Foreign Investment Law limits the share of foreign participation in Mexican companies to no more than 49% of the share capital (whether after the establishment of the company or at any time thereafter). Only with prior authorization from the Foreign Investment Commission is equity likely to be higher. However, it took a long negotiation process to obtain such authorization. In most cases it takes time (four to twelve months), troublesome and sometimes frustrating. This procedure has changed. On May 17, 1989, Mexico enacted a new foreign investment regulation.
