职能分离是法官与司法辅助人员岗位职权(责)划分的核心基础。现有法院人员分类管理改革处于攻坚阶段,但实践中存在规定笼统、操作多元等问题。其原因包括:宏观层面制度冲突的体制困局、中观层面机制改革有“分类”无“职能分离”和微观层面司法人员权责不一。下一阶段法院人员分类管理改革应以科学职能划分为导向,构建“分权—共享”的内部权力运行机制,形成由核心审判职能、非讼职能、纯审判辅助职能、诉讼关照职能构成的梯度性的权限配置,并成为定位全权法官(员额法官)、司法事务官(非员额法官)、法官助理和书记员四个岗位职权(责)的基础,最终构建符合司法规律的司法人员职能分类机制,以提高审判效能。
