借助行为实验探究大合议庭陪审制的认知行为是一次新的尝试。被试者的法学知识素养、决策规则、法官指示等多重因素对实验结果有较大的影响。通过对比实验发现,目前采用的“4+3”大合议模式是一种相对安全、有效的群体决策模式。
It is a new attempt to explore the cognitive behavior of the collegiate bench trial system through behavioral experiments. The subject’s knowledge of legal knowledge, decision-making rules, judge instructions and other factors have a greater impact on the experimental results. Through comparative experiments, it is found that the current “4 + 3” large-scale collegial model is a relatively safe and effective group decision-making model.
