法官在法治社会中具有崇高的地位,其薪酬保障应与其社会地位相称。然而,现行薪酬制度与法官应有的社会地位、劳动付出及职业风险并不相称,这不仅制约了大陆司法改革向纵深推进,也在一定程度上折射出现代司法理念的缺失。台湾地区司法改革背景与大陆相似,经过多年努力已形成一套相对完善的法官薪酬体系。两岸同宗同源,台湾地区的做法对于大陆重构法官薪酬制度、推进司法体制改革具有重要借鉴意义。
Judges have a high status in a society ruled by law and their salary guarantee should be commensurate with their social status. However, the present remuneration system is not commensurate with the due status of the judges, labor costs and occupational risks. This not only restricts the further progress of judicial reform in the Mainland, but also reflects the lack of modern judicial concepts to a certain extent. The background of judicial reform in Taiwan is similar to that in mainland China. After many years of hard work, a relatively complete system of judges’ remuneration has been formed. Both sides of the strait share the same origin with one another. The practice in Taiwan is of great reference to the mainland in remolding the remuneration system of judges and pushing forward the reform of the judiciary.
