Terminology is often a problem in making legal comparisons between one country and another or between major legal systems.Few areas of criminal procedure,however,present such severe difficulties in making comparisons as the topics of this paper--pretrial detention and arrest.The basic problem is that the pretrial detention and arrest procedures in the Anglo—American comInon law system differ significantly from the procedures used in the civil law countries and in many other countries.Traditional translation techniques compound the problem by giving the procedures names that make the procedures sound as if they are similar.
