网络消费合同,是电子商务活动不可或缺的重要内容,但在实践中存在着一些亟待解决的法律问题。当前立法对网络消费合同的规定,主要是在管辖和消费者权益保护这两个方面存在不足,可从加强专门立法和配套立法、准确适用相关法律原则、对网络消费合同与传统消费合同同等规制三个方面予以改进,从而完善对网络消费合同的法律规制,推进电子商务领域的依法治理。
