革命范式的终结,意味着超国家法时代的来临。法治吸纳革命的美国宪政版本,战胜了革命替代法治的苏联国家模式。革命范式的终结,也意味着民族国家时代面临着退潮。1648年“威斯特伐利亚二重奏”(William Twining语)~①所建构的民族国家法的内与外的二重格局,在全球法律地方化和地方法律全球化的浪潮中,开始衰退。
The end of the revolutionary paradigm means the advent of the era of supranarrative law. The rule of law absorbed the revolutionary constitutional version of the United States and defeated the Soviet state model of replacing the rule of law by revolution. The end of the revolutionary paradigm also means that the era of nation-state is facing ebb. The dual pattern of internal and external duality of the law of nation-state constructed in 1648 by the “William Twelve” (1) begins with the tide of global law localization and local law globalization decline.
