违法性认识在犯罪论体系中是一个重大的理论问题,从罗马法中的“不知法不免责”到现代的柔性修正,违法性认识对犯罪论产生了至关重要的影响。本文对大陆法系犯罪论中有关违法性认识的内容进行界定,并展开了对违法性认识是否属于犯罪故意构成要素的讨论。
The understanding of illegality is a major theoretical issue in the crime theory system. From the “I do not know law can not be discouraged” in Roman law to the modern flexible amendment, understanding of illegality has a crucial impact on the theory of crime. This article defines the content of the cognition of illegality in the criminal theory of the civil law system and starts the discussion on whether the illegality cognizance belongs to the deliberate element of crime.
