股份合作制企业是我国现阶段经济体制改革中涌现的一种新型的企业形式 ,正日益显示出它的顽强的生命力 ,使许多中小企业和集体企业充满了生机和活力。但由于我国在这方面缺乏有效统一的法律机制 ,因而在发展过程中出现了不少问题。鉴于股份合作制经济的不断发展和壮大 ,而有关立法却严重滞后 ,为了使股份合作制这种新的企业规范运作、健康发展 ,有必要制定一部健全、完善的股份合作制企业法。
Joint-stock cooperative enterprises are a new form of enterprises emerging in the current stage of economic restructuring in our country and are increasingly showing their tenacious vitality and making many small and medium-sized enterprises and collective enterprises full of vigor and vitality. However, due to the lack of an effective and unified legal mechanism in this area, many problems have arisen in the course of development. In view of the continuous development and expansion of the economy under the joint-stock cooperative system, the relevant legislation is seriously lagging behind. In order to ensure the healthy operation and development of the new enterprise under the joint-stock cooperative system, it is necessary to formulate a sound and complete joint-stock enterprise law.
