土地所有制是理解蒙古族封建社会的钥匙,学术界有私有制论和公有制论两种截然不同的观点。用西方法学概念去解释蒙古族的传统法律必然会得出错误的结论,因此,必须从蒙古族社会游牧经济的特点出发,才可以对蒙古族的土地所有制做出科学的判断。
Land ownership is the key to understanding the feudal society of Mongolian people. There are two completely different views on the theory of private ownership and public ownership in academia. The interpretation of the Mongolian traditional law by the concept of western law inevitably leads to erroneous conclusion. Therefore, we must make a scientific judgment on Mongolian land ownership from the characteristics of Mongolian nomadic economy.
