通过某水电工程在隧洞施工中发生塌方的案例,分析了塌方的主、客观原因,以及业主、承包商、监理对该案例的处理原则和具体补偿方法。对每一个重要问题和项目变更涉及的单位、合同价,都是经过各方反复协商、沟通,遵循以合同为依据,互相尊重、平等协商的原则。这也是FIDIC条款中友好解决争议的合同精神所在。监理人员在合同授权的范围内,实事求是、客观地履行合同,保证了工程建设的顺利进行。
Through a case of landslide occurred in the tunnel construction of a hydropower project, the main objective and objective causes of the landslide are analyzed, and the handling principles and specific compensation methods for the case by the owners, contractors and supervisors are analyzed. For each important issue and item involved in the change of unit, the contract price, after repeated consultations and communication by all parties, follow the contract as the basis, mutual respect, the principle of equal consultation. This is where the spirit of the contract for the friendly settlement of disputes in the FIDIC clause lies.
