我国历史上曾经经过两千多年的封面统治,对于各类刑法的制定与修改也经过了一个不断变化和发展的过程,其中死刑最为一个较为典型的罪民常常被人们拿来研究。基于我国古代立法沿革来讲,对于死刑的规定也进行了很多改革与尝试,但是在封面统治下,死刑的执行不仅方式类别众多,如较为常见的有:凌迟、骑木驴、腰斩等,惩罚方式较为残忍。而历代也对废除死刑争执不休。其中,结合当时社会发展背景,对废除死刑后的具体刑罚执行上,我们可以研究它的得与失。
