正确区分共同犯罪中的主犯、从犯,查清主谋,是准确定罪量刑的重要条件。在审判实践中,有些共同犯罪的被告人为了逃避法律责任,往往以狡猾的伎俩,编造虚假的供词,以掩盖事实真相,推卸罪责。尤其通过对吕××等轮奸案的审理,使我进一步体会到:审判人员要善于调取和使用证据,特别注意做好证人的思想工作,动员证人消除顾虑,提供真实情况,配合司法机关同犯罪分子做斗争。
