目前,随着北京地区房地产交易的持续升温,房贷纠纷亦成递增趋势。从2004年至2006年,北京市海淀区法院民三庭共审结房贷纠纷57件。纠纷的具体类型分为3种,其中担保合同纠纷50件;借款合同纠纷6件;房产买卖合同纠纷1件。3年间,房贷纠纷案件的数量总体上呈现增长趋势。其中2004年审结2件;2005年审结44件;2006年又审结了11件。通过对这些房贷纠纷案件的分析和总结.笔者发现目前购房贷款合同的订立和履行过程中,存在以下几方面值得贷款银行、开发商和购房人认真关注的法律风险。
At present, as Beijing real estate transactions continue to heat up, mortgage disputes also become an increasing trend. From 2004 to 2006, courts in Beijing’s Haidian District, Min Tribunal settled 57 mortgage disputes. The specific types of disputes are divided into three types, of which 50 cases of security contract disputes; loan contract disputes 6; real estate contract for sale of a dispute. In the past three years, the number of mortgage dispute cases showed an overall trend of growth. Of which 2 were concluded in 2004, 44 concluded in 2005 and 11 were concluded in 2006. Through the analysis and summary of these mortgage disputes, the author finds that there are some legal risks that the lenders, developers and buyers should pay close attention to in the process of entering into and fulfilling the contract of home purchase loan.
