本文介绍了晚清名案杨乃武小白菜案,并指出了该案对清代法制史研究之重要价值。在对该案的具体分析的基础上,本文选取法官责任制度为核心问题。通过分析在清代严厉的官僚责任制度下,初审官余杭县令刘锡彤敷衍了事、匆忙结案的心理过程,探讨了晚清有关法官责任规定实现的可能性及其对司法官员行为的激励作用与负面导向。
This article introduces the case of cabbage in the late Qing dynasty named Yang Naiwu and points out the value of the case to the study of legal history in the Qing Dynasty. Based on the concrete analysis of the case, this article selects the judge responsibility system as the core issue.
