随着十八届三中全会闭幕,小产权房上市交易合法化传闻再起。在我国现行制度下,小产权房市场开发的违法性毋庸置疑,但却屡禁不止。本文拟通过运用文献研究、比较研究、历史研究等综合研究方法,明确定义小产权房概念,梳理相关政策规定的历史发展,在此基础上分析宅基地制度,并为解决小产权房困境提出建议,以期对相关研究有所参考。
With the closing of the Third Plenary Session of the 18th CPC Central Committee, the legalization of the listing of small property houses is resurrected. Under the current system of our country, there is no doubt about the illegality of the development of small property market, but it has been repeatedly banned. This article intends to clarify the concept of small property room and comb the historical development of the relevant policies and regulations by comprehensive research methods such as literature research, comparative research and historical research. Based on this analysis, we will analyze the system of house land and provide suggestions for solving the dilemma of small property room , With a view to relevant research for reference.
