随着经济发展,行政机关越来越多的依法行使着行政指导的行政行为。本文通过分析行政指导定义;研究行政指导积极作用;归纳行政指导存在的问题;指明行政指导行为中缺失行政诉讼、行政赔偿的法律制度。从而合理建议:在行政指导行为中,应该建立健全诉讼、赔偿的法律体系。
With the economic development, more and more administrative agencies exercise the administrative guidance of the administrative act according to law. This article analyzes the definition of administrative guidance; studies the active role of administrative guidance; summarizes the problems existing in administrative guidance; points out the legal system that is lack of administrative litigation and administrative compensation in administrative guidance. Therefore, it is reasonable to suggest that in the course of administrative guidance, a legal system of lawsuit and compensation should be established and improved.
