保障措施是多边贸易协定中的重要内容。它的目的是 ,使多边贸易协定的缔约国在因进口产品数量骤增以至于对国内相同产业造成损害或威胁时 ,有权对该种产品进口进行限制。本文结合美国对主要钢产品实施临时保障措施案 ,分析了WTO《保障措施协议》的实施条件及实施保障措施的影响。通过分析得出两个结论 :WTO《保障措施协议》中对实施保障措施的条件的规定存在着问题 ,这是出现因实施保障措施而导致的贸易保护主义的重要原因 ;实施保障措施对全球经济福利有不利的影响
Safeguards are an important part of multilateral trade agreements. Its purpose is to enable States parties to multilateral trade agreements to impose restrictions on the import of such products when the volume of imports is so sharp that they jeopardize or threaten the same domestic industries. This article, combined with the case of the United States on the implementation of temporary security measures for major steel products, analyzes the implementation conditions of WTO “Safeguards Agreement” and the impact of the implementation of safeguards. Through the analysis, we can draw two conclusions: there are problems in the WTO Agreement on Safeguards, which is the important reason for the emergence of trade protectionism due to the implementation of safeguards.
