在审查逮捕案件中,以证据不足不予批准逮捕的案件占总数比例不低。此类案件事实不清楚、社会关系不稳定、法律监督难度高,同时往往后续处理时间长,社会风险较高,因此近年来越来越受到侦查监督部门的重视。如何解决证据不足不予捕案件的后续处理,必须深入研究此类案件的特点,兼顾程序与实体,变被动为主动,拓展监督途径,强化监督效果。
In examining the arrests, the percentage of cases arrested on the basis of insufficient evidence was not low. Such cases are not clear facts, instability in social relations, legal supervision is difficult, often followed by a long time, social risk is high, so in recent years more and more subject to the supervision and inspection departments. How to solve the problem of not catching the cases of follow-up without sufficient evidence, we must thoroughly study the characteristics of such cases, give consideration to procedures and entities, change from passive to active, expand the channels of supervision, and strengthen the effectiveness of supervision.
