我国法律传统讲究情理、法理的互通,这是舆论得以影响司法的重要因素,因此在我国司法实践中从来就不存在“舆论是否应当影响司法”的应然问题,人们应该关注的是一个“舆论如何影响司法才具有正当性”的实然问题。在此背景下,人们没有必要探究舆论监督司法的必要性问题,而应当审视舆论如何监督司法才具有正当性、合理性,并合理开展舆论监督,促进司法公正的实现。
The legal traditions in our country pay attention to reason and the exchange of jurisprudence. This is an important factor that mediates the influence of public opinion on the judiciary. Therefore, there should be no such issue as whether public opinion should influence the judiciary in our judicial practice. One should pay attention to “How public opinions affect the legitimacy of the judiciary ”. Under this background, people do not need to explore the necessity of public opinion on the supervision of the judiciary. However, it is necessary to examine the validity and rationality of how public opinion supervises the judiciary. The public opinion should be properly supervised to promote the realization of judicial fairness.
