20世纪70年代以来,在伊斯兰法复兴运动的影响下,原教激进主义者要求废除1948年《埃及民法典》中有关利息制度的第226条以及该法典的效力。本文通过分析最高法院的相关案例和宪法第2条修正案,进而发掘此次伊斯兰世界法律冲突的根源与实质,即,在世俗法与宗教法并存的“二元化”国家里,受西方法律文化影响较深的“私法”与受传统伊斯兰文化影响较深的“公法”之间的矛盾。
Under the influence of the Islamic Renaissance in the 1970s, fundamentalist activists demanded the repeal of article 226 of the Egyptian Civil Code of 1948 relating to the interest regime and the effectiveness of the Code. By analyzing the relevant cases of the Supreme Court and the amendment of Article 2 of the Constitution, this article explores the root causes and essence of the legal conflicts in the Islamic world.
