基于船舶的侵权适用物的侵权法理论,船舶碰撞的国际公约和各国海商法普遍将船舶直接规定为碰撞的责任主体,然而船舶侵权最终责任人还是要落实在人的身上,适用人的侵权理论。但是《海商法》以及《1910年碰撞公约》都是将船舶列为侵权行为的主体。所以本文结合《关于审理船舶碰撞纠纷案件若干问题的规定》第四条的规定以及当代侵权法的发展趋势,结合传统侵权理论——实际控制论及当代侵权理论——实际受益论,浅析船舶碰撞责任的承担主体。
Based on the theory of tort law of the infringing property of ships, the international conventions on ship collisions and the maritime laws of various countries generally stipulate directly the ship as the main body of collision, however, the ultimate responsible party of ship infringement should still implement the human rights infringement theory . However, both the Maritime Code and the 1910 Collision Convention list ships as the subject of infringement. Therefore, this article combined with the provisions of Article IV of “Provisions on Several Issues Concerning the Trial of Ship Collision Dispute” and the development trend of contemporary tort law, combined with the traditional theory of tort - actual control theory and contemporary tort theory - practical benefit theory, The subject of collision responsibility.
