宪法学的地位与特性取决于宪法的性质。在美国,宪法的内容通常在联邦最高法院与美国人民之间的对话中经商谈而得到议定。正因此,宪法学旨在通过阐释宪法可能发展的系统与法理意涵,从而去调节这种对话。而在欧洲,宪法之存在相对更加独立于政治对话;因此欧洲的宪法学相对来说更加自治。在欧洲宪法学者的想象中,他们的任务是要去发展出一套非政治化且内在融贯的宪法规范
The status and characteristics of constitutional law depend on the nature of the constitution. In the United States, the constitutional content is usually negotiated in the dialogue between the Federal Supreme Court and the American people. Therefore, the purpose of constitutional law is to regulate the dialogue by explaining the constitutional and legal implications that the Constitution may develop. In Europe, the existence of the constitution is relatively more independent of political dialogue; therefore, constitutional law in Europe is relatively more autonomous. In the imagination of European constitutional scholars, their task is to develop a set of non-politicized and inherently coherent constitutional norms
