旅游资源的法律保护主要集中于国家层面之法,而青海这样的民族大省,在现有正式性法律框架下,创新旅游资源保护进路,即发挥习惯法主导性作用,更有益于青海省旅游资源的切实保护。本文试以旅游资源的法律保护为出发点,探寻习惯法作为青海省旅游资源法律保护的路径,以期发挥其特殊调整功能。
The legal protection of tourism resources mainly focuses on the law of the state level. However, under the current formal legal framework, the major national province of Qinghai is to innovate the approach of protecting tourist resources, that is, to play a leading role in customary law and be more beneficial to Qinghai Province Practical protection of tourism resources. This paper tries to take the legal protection of tourism resources as the starting point and explore the customary law as the legal protection of tourism resources in Qinghai Province, in order to play its special adjustment function.
