当今社会出现了很多见死不救的情形,“小悦悦事件”就是其中之一,人们不是不愿意见义勇为,而是在见义勇为后个人的利益没有保障。在如今人人自危的情况下,我国道德严重滑坡,保障个人的利益尤其重要,道德法律化作为其中一个有效途径,有其必要性。最近,十二届全国人大五次会议通过了《中华人民共和国民法总则》,该总则第一八十三条、一百八十四条保障了见义勇为者的利益,鼓励了见义勇为行为,从法理学的角度分析这就是道德法律化的一个很好的例证。
