不动产协助执行是不动产执行中的一个具体环节。不动产行政主管机关根据法院送达的协助执行通知书协助执行,以协助执行通知书所记载的内容为依据。不动产行政主管机关对协助执行通知书不进行实质审查,其协助法院执行的行为的合法性不容质疑。我国不动产行政主管机关在不动产协助执行中存在缺乏操作性、责任不明确等问题。
