《农业保险条例》已经2012年10月24日通过,2013年3月1日起施行。条例规定,任何单位和个人不得利用行政权力、职务或者职业便利以及其他方式强迫、限制农民或者农业生产经营组织参加农业保险。农民或者农业生产经营组织投保的农业保险标的属于财政给予保险费补贴范围的,由财政部门按照规定给予保险费补贴。国家鼓励地方人民政府采取由地方财政给予保险费补贴等措施,支持发展农业保险。保险机构经营农业保险业务依法享受税收优惠。禁止以任何方式骗取农业保险的保险费补贴。
The Agricultural Insurance Ordinance was passed on October 24, 2012 and came into effect on March 1, 2013. The regulations stipulate that no unit or individual may compel or restrict farmers or agricultural production and management organizations to participate in agricultural insurance by using administrative powers, positions or occupational facilities and other means. Subsidies for agricultural insurance insured by peasants or agricultural production and operation organizations belong to the scope of subsidies for insurance premiums granted by the finance department, and subsidies for premiums shall be given by the financial departments in accordance with the provisions. The state encourages the local people’s governments to take such measures as subsidies for premiums given by the local government to support the development of agricultural insurance. Insurance institutions operating agricultural insurance business enjoy tax incentives according to law. No way to defraud agricultural insurance premium subsidies.
