本文以服刑人员子女问题为切入点,运用刑事一体化的思维方法,在静态方面,以刑事执行(特别是其中的自由刑执行)为中心,以犯罪学中的被害人学为参考展开叙述,提出刑事执行的一项重要的负面功能是对原有社会关系的破坏;在动态方面,以刑事执行与犯罪学的互动关系为线索,建立起“犯罪学——刑事法学(实体法学、诉讼法学)——刑事执行法学(——犯罪学)”的思维框架,提出通过刑事执行预防犯罪的一个重要方面在于对服刑人员原有社会关系的维持和强化。最后,提出了可能的制度改进路径。
This article takes the issue of prisoners’ children as the breakthrough point. By using the method of integrated criminal thinking, this article focuses on the criminal enforcement (especially the execution of free criminal punishment) and the narcotics of criminology in criminology An important negative function of criminal execution is the destruction of the original social relations. On the dynamic aspect, taking the interactive relationship between criminal execution and criminology as a clue, “criminology-criminal law (substantive law, procedural law ) - Criminal Enforcement Jurisprudence (- Criminology) ”, and put forward that one of the important aspects of crime prevention through criminal enforcement lies in the maintenance and strengthening of the original social relations of prisoners. Finally, we put forward some possible ways to improve the system.
