随意撤换和调动居委会成员的事情似乎比比皆是,关于此类事件的投诉和情况反映不绝于耳。有些事件,经我们的调查和报道已经得到一定程度的解决;可是,更多的事件并没有从根本上解决问题。江苏省连云港市某社区居委会副主任刘燕反映的情况告诉我们一个新的动向:街道为了逃避“违法”嫌疑,把社区居委会推上了前台。也因此把本为自治组织的居委会推上了违反自治法律的被告席。事情的根源到底在哪里?实践中出现的问题,往往要在制度和理论上找根源。对居委会成员的产生机制以及居委会工作的运行机制,我们经历了从“小脚侦缉队”到“街聘民选”的改革,我们经历了强化居委会建设的种种转变。但是,如同任何事物都有它的两面性,在收获新机制带来的工作成果的同时,我们也应该想一想它带来了什么样的负面影响?任其发展下去,会不会把我们已有的改革引入歧途?几位嘉宾的剖析给了我们新的视角、新的启示。希望有更多关心社区民主自治建设的同仁参与我们的讨论。
The arbitrary removal and mobilization of members of the neighborhood committees seems abound. Complaints and circumstances concerning such incidents have been heard endlessly. Some incidents have been solved to some extent through our investigations and reports; however, more incidents have not fundamentally solved the problem. The situation of Liu Yan, deputy director of a neighborhood committee in Lianyungang City, Jiangsu Province, tells us a new trend: in order to escape the suspicion of “breaking the law,” the streets were put on the front line. As a result, the neighborhood committee, which is an autonomous organization, has been pushed to the dock in violation of self-governing laws. Where is the root cause of the problem? Problems in practice, often in the system and theory to find roots. We have undergone a series of reforms to strengthen the construction of neighborhood committees, such as the mechanism of the production of neighborhood committees and the operation mechanism of neighborhood committees. However, as everything has its duality, we should also think about the negative impact it has on the fruits of the work brought about by the new mechanism.
