On March 14, 2004, with the amendment passed at the Second Session of the Tenth National People’s Congress (the “Constitution”), the new term “state of emergency” was first introduced into the current constitution. At a time when people have speculated on this rather strange concept of the system, Tsinghua University School of Public Management commissioned by the Legislative Affairs Office of the State Council, has launched an intense state of emergency legislation and drafting work. Recently, the “Emergency Law” draft proposal drafted by the relevant task force of Tsinghua University has been submitted to the Legislative Affairs Office of the State Council. If all goes well, the State Council will form a formal “emergency” on this basis
