在法解释学中,解释不仅被界定为认知方式和存在方式,亦被运用为司法操作方法和心理沟通途径,而解释之属性决定解释的功能,因而,明确解释的功能须以确定解释之属性为前提。对于刑法解释而言,则当以醇化其认知属性,为界定其功能之基础。而作为认知方式的刑法解释,其基本功能则体现为:其一,澄清不明确刑法概念,揭示刑法文本隐晦含义,进而阐明刑法文本自身含义;其二,对刑法文本作以价值填充,从而使不确定刑法概念及评价性规定之刑法规范意旨明晰、具体。
