经济全球化的发展和知识经济进步使得本身具有垄断性和地域性的知识产权被推到了国际保护的浪尖。发达国家以其丰富的知识产权作为发展经济的一大筹码而力图推动知识产权法律保护的全球化,同时发展中国家又期待以一个完整的知识产权机制采带动国内经济的腾飞继而纷纷加入接轨国际立法的行列。1994年世界贸易组织取代关贸总协定,TRIPs协议的缔结将国际贸易知识产权化。发展中国家的过渡期已过,知识产权立法的一体化,使得知识产权的国际保护进入了后TRIPs时代。而此时,TRIPs协议的发展将意味着更多。
