《深圳经济特区医疗条例》施行后,在深圳医疗监督中应处罚的违法行为发生了较大变化,其中《深圳经济特区医疗条例》第三十七条第一款第(三)项关于使用不符合岗位要求的卫生技术人员的规定被视为多种违法行为的兜底条款,可以调整诸多违法行为。本文回顾了2017年1月深圳G区立案的一起医疗卫生行政处罚案件,该案行政处罚事先告知时认为医疗机构使用非卫生技术人员开展医疗卫生技术活动,当事人陈述申辩后最终认定为医疗机构使用不符合岗位所需的任职资格的卫生技术人员。本文分析讨论了陈述申辩后改变法律适用是否需要在行政处罚决定前进行二次行政处罚事先告知等问题,希望能为类似案件提供参考。
After the implementation of the “Shenzhen Special Economic Zone Medical Regulations”, there has been a big change in the illegal acts that should be punished in Shenzhen’s medical supervision. Among them, Article 37 (1) (3) of the “Medical Regulations of Shenzhen Special Economic Zone” The regulations of health technicians who meet the requirements of the post are considered as a comprehensive clause of many kinds of violations and many illegalities can be adjusted. This article reviews a case of medical and administrative sanctions filed in Shenzhen G District in January 2017. The administrative sanction in this case is that medical institutions use non-medical technicians to carry out medical and health technical activities prior to the medical administrative sanctions. After the parties’ statements are defended, they are finally recognized as medical institutions Health technicians who do not qualify for the position required. This article analyzes and discusses such issues as changing the application of law after prior to the defense of the statement whether it is necessary to make a second administrative penalty prior to the administrative punishment decision, and hopes to provide a reference for similar cases.
