“社会管理”是一个发展性概念。经济发展到特定阶段,社会原有管理模式滞后,失范的危机显现,更高层级的社会需求在法律中得到回应。改革与创新社会管理的实质并不是一般意义上构建新规范,而是在市场经济不断发展的前提下建立法治社会,实现公平、正义、民主,促成各种合理政治利益诉求实现。这是尊重民权与改善民生的价值依归,是人类需求的更高层级的追求,是公民自身价值的更深层次的实现。用法治建设推进社会建设与管理是时代的迫切要求,而其中关键在于落实现行宪法。协商民主制度的建立与结社自由共同推动第三部门的兴起,可以说这是当前构建宪法实施机制创新社会管理的有效途径。
“Social Management ” is a developmental concept. At a certain stage of economic development, the original mode of management in society lags behind and a crisis of anomie emerges. Higher-level social needs are answered in the law. The essence of social management of reform and innovation is not the construction of new norms in a general sense but the establishment of a society under the rule of law under the premise of continuous development of the market economy and the realization of fairness, justice and democracy and the promotion of various legitimate political interests. This is the value of respecting civil rights and improving people’s livelihood. It is the pursuit of a higher level of human needs and a deeper realization of the values of citizens. The construction of the rule of law to promote social construction and management is an urgent requirement of the times, and the key lies in the implementation of the current constitution. The establishment of consultative democracy and the freedom of association jointly promote the rise of the third sector. It can be said that this is an effective way to construct the mechanism of constitutional implementation and to innovate social management.
