检察机关参与社会管理,既为其他社会机构行使社会管理职能提供优良外部环境,同时也是在行使自身社会管理职能。检察机关由于其自身法律职责和实践中享有的便利条件,可在公益诉讼中发挥重要职能,通过维护国家及公共利益来实现自身参与社会管理的职能。文章通过分析检察机关提起公益诉讼的理论基础、提起公益诉讼的条件、优势,望能为我国建立检察机关承担民事公益诉讼制度提供一定参考。
The participation of procuratorial organs in social management not only provides an excellent external environment for other social organizations to exercise their social management functions, but also exercises their own social management functions. The procuratorial organs, because of their own legal responsibilities and the conditions of convenience enjoyed in practice, can play an important role in public interest litigation and realize their functions of participating in social management through safeguarding the interests of the state and the public. By analyzing the theoretical basis of the public interest litigation initiated by procuratorial organs and the conditions and advantages of public interest litigation, the article hopes to provide some reference for our country to establish the public interest litigation system.
