一、海外中国留学生可否在国外申请专利? 答:可以。我海外留学生在国外作出发明创造,想在国外申请专利,可以根据所在国的专利法及有关规定进行申请。如明显属于职务发明创造的,经报使馆科技处核实后,按照所在国的法律规定,专利权由我国留学生在外所属单位申请办理。如果属于非职务发明创造的,应力争通过我方使馆科技处同国内有关主管部门联系,酌定处理方法。 二、 海外留学生可否在国内申请专利? 答:可以。我海外留学生向国内申请专利,一般可分为两种情况:一是属于职务发明创造,自己可独立申请专利;二是在中外科技合作项目中,中方人员在国外作出的发明创造,除另有协议外,申请专利的权力属于中方人员的国内派出单位,并可根据情况,报使馆科技处,直接在国外申请或先在国内申请专利。
