八旗制度是清代一项很重要的制度,它集军事、生产、行政等功能于一身,它的产生源于女真人的社会生活,最初源于满洲(女真)人的狩猎组织,是清代旗人的社会生活军事组织形式,也是清代的根本制度,在一定程度规范了旗人言行,有很高的法学价值。由于满族是发源于我国东北的少数民族,八旗实行兵民合一,兼具军事、行政和生产等多方面的职能,清建国初期满族人口只有几十万人,在短短的几十年中取代了大明王朝,统治了近一亿的汉蒙苗回藏人民三百多年。在康乾盛世时期社会发展水平达到我国封建历史繁荣的顶峰。满族在经济政治文化水平远远落后于中原王朝的情况下,有如此大的成就,这一切成就背后支撑他的就是八旗制度。清太祖皇帝努尔哈赤创立了八旗制度,主要规定了满族社会以一种耕战结合的形式来统治。旗人战时为兵平时为民,兵民合一大大提高了战斗力和生产能力。这种制度逐渐成为清朝的法律制度,影响着清朝法律政治的各个方面。
