随着社会的发展和人们权利意识的提高,新刑事诉讼法引入了刑事强制医疗程序。这一制度直接关系到公民个人权利的保障,同时也关系到社会公共秩序正常运行,而且在司法实务中也尤为重要。但其适用仍存在着问题,例如适用对象过于狭窄,鉴定程序和鉴定标准不统一,利害关系人的权利救济难以保障等等,需提供相应措施予以完善。
With the development of society and people’s awareness of rights, the new Criminal Procedure Law introduces the criminal compulsory medical procedure. This system is directly related to the protection of individual rights of citizens, but also relates to the normal operation of public order, and is also particularly important in judicial practice. However, there are still some problems in its application. For example, it is too narrow for the applicants, the procedure for appraisal is not uniform with the appraisal standards, the relief of the rights of the interested parties is difficult to guarantee, and so on, and the corresponding measures need to be perfected.
