公正与公平待遇标准是国际投资条约中一项重要的外资待遇原则,也是最容易引起争议的待遇标准之一。《北美自由贸易协定》第11章投资规则规定了公正与公平待遇标准,NAFTA仲裁实践则进一步澄清与发展了该待遇标准。
The principle of fair and equitable treatment is an important principle of foreign investment in international investment treaties and one of the most controversial treatment standards. The NAFTA Investment Rules Chapter 11 sets forth the fair and equitable treatment standard, while NAFTA’s arbitration practice further clarifies and develops the standard of treatment.
