★案情简介职工张某和某化工企业签订了3年期劳动合同,约定试用期为6个月。在试用期间,张某勤勤恳恳、兢兢业业,表现一直很好,企业也没有提出任何异议。试用期将满,企业人力资源部忽然通知张某,说他不符合录用条件,企业决定不予录用,从次日起就可以办理交接手续,不用上班了。张某很郁闷,企业没有指出自己在哪些方面存在不足或者和录用条件不符,在没有任何事实依据的情况下,就以“不符合录用条件”为由。很主观、随意地辞退自己,侵犯了自己的劳动权。他到镇江市总工会上访,询问企业这样的做法是否有依据,试用期员工企业难道就能随意解除?
