党的十八届四中全会首次在中央全会上专题研究依法治国相关问题,通过了《中共中央关于全面推进依法治国若干重大问题的决定》(以下简称《决定》),明确了建设社会主义法治国家的性质、方向、道路、抓手。十八届四中全会在部署全面推进依法治国时,还以“坚持中国共产党的领导”为基本原则,回答了党的领导和依法治国的关系这个法治建设的核心问题,为建设社会主义法治国家提供了基本遵循。全会《决定》的第二、第七部分对这个问题进行了回答,
