劳动保障年检制度,是劳动保障用工年检制度的简称。它是加大劳动执法力度的一项重要措施,也是各级劳动保障部门维护劳动者合法权益,规范劳动保障用工市场秩序的有效手段之一。原劳动部和省劳动厅为此专门做出规定,各级劳动保障部门按照劳动监察的范围每年都必须开展一次用工年检。但是通过调查发现,对这项非常重要的制度在实践中却存在着认识上的误区,以致使该项制度的作用在实践中没有充分表现出来。误区之一:劳动保障年检性质认识上的误区。劳动保障年检是劳动保障行政部门对用人单位遵守劳动法律、法规情况进行全面监督检查的一项措施,是劳动监察执法的有效形式。换言之,年检是一项劳动执法行为,而非劳动力管理行为。对执法过程中发现的被检单位用工上
