在诸多相关因素中,能源资源的开发利用对当下引起全球广泛关注和热烈争论的气候变化问题影响最大。就法律规制层面而言,能源产业的法律调控与应对气候变化的立法努力亦密切相关。在履行国际法义务的外部压力和建设社会主义生态文明的内部需求的推动下,我国目前正在抓紧研究和制定应对气候变化专门立法。在此背景下,我们选择了一组论文,分别从推进我国应对气候变化专门立法的具体进路、对“适应”和“减缓”两个侧面均具有重要意义的能源节约法制、对城市区域温室气体排放具有极大影响作用的能源规划以及在法律责任层面确保应对气候变化法应有的威慑力和实效性、美国页岩气开发的环境法律规制等角度展开讨论,以期中观和微观视角探讨能源与应对气候变化法制建设的诸多重要范畴,为国家应对气候变化专门立法建言献策。
Among many relevant factors, the development and utilization of energy resources have the greatest impact on the climate change issues that have caused widespread global concern and heated debate. As far as the legal regulation is concerned, the legal regulation and control of the energy industry is also closely related to the legislative efforts to combat climate change. Under the external pressure of fulfilling the obligations of international law and the internal demand of building a socialist ecological civilization, our country is now paying close attention to studying and formulating special legislation on climate change. Under this background, we have selected a group of papers, which are from the concrete approaches of advancing our country’s special legislation on climate change and have the important energy-saving legal system on both the “adaptation” and the “slowdown” Energy planning that has a great influence on the urban area’s greenhouse gas emissions and the deterrent force and effectiveness that should be ensured at the level of legal responsibility to tackle the climate change law and the environmental laws and regulations on shale gas development in the United States. And micro perspectives on energy and climate change to address the many important areas of legal construction for the country to address climate change legislation to provide advice and suggestions.
