各省,自治区、直辖市建委(建设厅),北京市政管理委员会,各计划单列城市建委:最近,一些省建委(建设厅)及部分城市房地产行政主管部门反映:有的地方出现了工商行政管理部门行使房地产管理职能,办理房地产抵押登记的情况。我部认为,这种做法是不符合国家房地产管理有关法律和法规的规定,不符合我国历来进行房地产抵押登记的管理做法和工作程序。一、房地产抵押登记,是房地产权属登记管理的重要组成部分,根据《城市房地产管理法》的规定,这项工作应由房地产行政主管部门办理.《城市房地产管理法》第四十六条规定:“房地产抵押,是指抵押人以其合法的房地产以不转移占有的方式向抵押权人提供债务履行担保的行为”.这表明房地产抵押实质上是房地产产权的抵押,房地产抵押是设定在房屋所有权上的一种他项权利,在进行产权管理时房地产抵押需要办理他项权利登记,这是房产权属管理的一个组成部分。《城市房地产管理法》第六十条规定,房地产行政主管部门是房地产登记、核实并颁发房地产权属证书的管理机关.因此,房地产他项权利的登记、发证,是房地产权属管理的不可分割的部分,必须由房地产行政主管部门办理.
