省级以下人民法院和人民检察院人财物统一管理,只涉及人、财、物三个方面,不包含事权,不是垂直管理。理论和实践证明我国司法机关不宜实行垂直管理。人财物统一管理后,可能引发上访处置难、执行不力、个案协调难度增加、家属子女无助、队伍管理出现空档等问题。为此必须坚持地方党委统一领导,自觉接受人大及有关方面监督,积极服务地方经济社会发展。
The people’s court at the provincial level and people’s procuratorates under the unified administration of property only involve people, money and property, which do not include power of attorney, nor are they vertically administered. Theory and practice prove that it is not appropriate for our judiciary to implement vertical management. After the unified management of people and property, it may lead to problems such as difficulty in visiting petitions, ineffective enforcement, difficulty in coordinating cases, lack of support for family members and children, shortage of team management and so on. To this end, we must uphold the unified leadership of the local party committees, conscientiously accept the supervision of the NPC and other relevant parties and actively serve the local economic and social development.
