韩非于是法家思想的集大成者。法家思想以“性本恶”为假设,以“势·法·术”为要义。“势”是指权势、地位;“法”是指法律、规律;“术”是指方法、手段。法家认为,如果每个人都“从人之性,顺人之情”,那么人类社会终将变成弱肉强食的世界。因此,必须“制法度”,“以矫饰人之性”。当然,“以法制之”必须“因道全法”。“道”是中国哲学中一个独特的概念。“形而上者谓之道,形而下者谓之器”。世界上任何一个具体的事物(器),都有它存在的规律,这就是“道”。“以法制之”和“因遭全法”就是韩非子用人思想的基本要义。
Therefore, Han Fei is a master of legal thought. Legalism is based on the assumption of “evil nature” and “potential, law and technique”. “Potential” refers to power and status; “Law” refers to law and law; “Art” refers to methods and means. Legalists believe that if everyone is “human-natured, sincere”, then human society will eventually become a jungle world. Therefore, we must “rule of law”, “to man’s sexuality.” Of course, “the legal system” must be “because of the law.” Tao is a unique concept in Chinese philosophy. “The metaphysical means that the metaphysical means”. Any concrete thing in the world has its existing laws. This is the Tao. “The legal system” and “because of the whole law” is the basic meaning of Han Fei’s idea of employing people.
