国内农药生产企业和科研单位利用专利申请保护研究成果时,有几个基本问题需要注意。恰当选择申请专利的时机什么样的发明有必要申请专利,什么时机申请专利,是国内企业和科研单位在实践中应不断探讨的问题。应当明确申请专利的目的,以能否获得最大的商业价值为依据,恰当地掌握专利申请的时机。同时还要避免受人为因素影响,将技术过早公开。中国石化总公司是目前国内专利申请最大的公司,他们在申请专利中发现,石化领域某些国内的先进技术刚刚申请专利公开不久,国外的大公司就相同的技术主题,申请了许多件外围专利。很明显,国外公司追踪研究了我们的技术,进行了进一步的开发,使我们专利实施的价值下降。
